Penalty/Premium: Below mentioned penalties to be applicable to quality parameters hereunder
determined as stipulated at clause sampling/analysis.
+ A penalty of USD -.-- per mt per each 1% below 88% fixed carbon (dry basis)
(88% excluded), scale pro-rata basis down to 86%. Any percentage below 86% is
subject to rejection of whole cargo.
+ In the event that the moisture is more than 10% excess moisture to be deducted
from weight.
+ In the event that the total Sulphur (dry) is more than 1.5% (one point five pct. excl.),
the cargo to be rejected.
+ Any undersize determined at discharging port by the independent inspection
company INCOLAB/SGS, will be subject to penalty of USD .-- per mt per each
1%. However, any underweight exceeding 5% will be subject to addition claim
and/or rejection at Buyer’s discretion.
+ Cargo is subject to rejection when and if discharging port analysis findings are not
within acceptance parameters (as below) set out by Ministry of Environment Of
County of Disposal . Fixed carbon (ash dry basis): min 86%; Volatile (dry) : max 14%
In case rejection conditions arise, Ministry of Environment regulations to apply. 
Final Weight: Customs weight bridge at port of discharge will be final for settlement as per report
issued by INCOLAB / SGS / , whose charges will be on Buyer’s account at
discharge port. Any shortage/surplus will be reimbursed to the Buyer/Seller within
15 days after discharge of the vessel.
Final Quality: Sampling to take place during discharge by INCOLAB/ SGS / at Discharge
port and analysis to be carried out by INCOLAB /SGS / out of samples
extracted as per above quality to be final as per INCOLAB / SGS / whose
cost will be on Buyer’s account.
In the event that analysis carried out by INCOLAB/ SGS / out of samples
extracted during discharge of vessel at related pier and sealed
showing vessel name and date, show a difference of more than 2 points deficiency
versus related buyer factory laboratory findings for fixed carbon (dry basis) ex samples
representing the whole cargo and sealed by INCOLAB /SGS / , seller and
buyer to mutually agree on an umpire laboratory in Europe, and send a third sealed
umpire samples of INCOLAB /SGS for analysis. The findings of the umpire
laboratory will be final between the parties.
The cost of the umpire shall be paid by the party whose assay differs from the
umpire by a wider margin then the difference between the other’s party’s assays. In
